Under N.J.S.A. 4:19-16, an owner is automatically liable for injuries caused by their animal’s bite if the victim was in a public place or lawfully on private property at the time of the attack. There is no requirement to prove the owner knew the animal was dangerous. There is no “one free bite” rule. Liability attaches from the very first incident.

Children are the most frequent victims of animal attacks nationally, and New Jersey courts have consistently recognized that children — particularly those under the age of seven — cannot be held to the same standard of care as adults. The doctrine of contributory negligence does not apply to very young children in the same way it might to an adult.

A six-year-old who ran toward a dog on a neighbor’s lawn is not expected to appreciate the risk in the way a reasonable adult would. Courts look at the child’s age, maturity, and capacity to understand danger when assessing any potential fault on the child’s part.

The Extended Statute of Limitations: A Critical Protection

One of the most important legal protections for injured minors in New Jersey is the tolling of the statute of limitations. While adult victims generally have two years from the date of injury to file a claim under N.J.S.A. 2A:14-2, the clock does not begin running for a minor until their 18th birthday. Where a landlord knew or should have known that a tenant kept a dangerous animal on the property, New Jersey courts have found landlords liable alongside the animal’s owner. This is particularly relevant in multi-family housing situations, where children from neighboring units are often the victims. The landmark analysis in Linebaugh v. Hyndman and subsequent NJ decisions established that property owners owe a duty of care to lawfully present guests and visitors — including children playing in common areas.

Insurance Policy Stacking
