Our attorney, David J. Cowhey, can attest that not all dog bite claims can settle without involving the New Jersey Court system.  If your dog bite claim does not settle after the dog owner’s insurance company has reviewed and responded to our demand package, the next step is to file a formal Complaint with the Superior Court of New Jersey, either in the New Jersey county in which the dog bite victim resides, or in the New Jersey county where the dog attack occurred.

In legal terminology, a Complaint is any formal legal document that sets out the facts and legal reasons that the Plaintiff (dog bite victim) believes are sufficient to support a claim against the party against whom the claim is brought (the defendant) that entitles the dog attack victim to a remedy, or monetary damages for your dog bite injuries.  In Civil Law, a Complaint is the very first formal action taken to officially begin a lawsuit. This written document contains the allegations against the defense, the specific laws violated, the facts that led to the dispute, and any demands made by the plaintiff to restore justice.  In our dog bite Complaints, we set forth our position that the actions of the dog’s owner were negligent, and therefore violate the terms of the New Jersey Dog Bite Statute, NJSA 4:19-16, which state that if a dog bite victim was legally on the premises where they were bitten, and if they did not provoke the dog that attacked them in any way prior to being bitten, then the dog’s owner can be held liable for damages.  Your dog bite claim may not be able to settle without taking the dog’s owner to Court.  Make sure that you select an attorney with over 30 years of trial experience and litigating dog bite claims to his credit.  Mr. Cowhey has won millions of dollars for his clients, fighting for them in Court.  Call David J. Cowhey, the South Jersey Dog Bite Lawyer, today at (609) 653-9200 or try our 24/7 Attorney Hotline at (609) 513-0627 or our new line at (888) DOG-ATTY for a free consultation and review of your dog bite case.
