Pitbull looking through fence

In a horrifying recent dog attack, two pitbulls mauled a three-year-old child to death. The attack was recently reported on the nj.com website

The attack happened in Carteret. It is believed the dogs dug under the fence of the property adjoining the backyard where the three-year-old lived. The boy’s mother tried to fight off the dogs and is in hospital with serious injuries. It was the child’s first time playing in the yard; the family of five – a mother, father, and three boys – had just recently moved to the area.

The Dogs Responsible

The dogs were not registered, which is the law in the borough of Carteret. Some neighbours in the community have described the dogs as previously being aggressive, and some have said they have not displayed any aggressive behaviour in the past. It is believed the dogs have now been euthanized.

As a lawyer that specializes in dog attack cases throughout New Jersey, Mr Cowhey was asked to comment on applicable laws that would be applied in a case like this. Legally, the owner of the dogs is now liable for the damages that have been caused. If the dogs’ owner has home or rental insurance, the insurance company will become responsible for paying either damages or a settlement. If the dogs’ owner does not have insurance, it may be unlikely the victims will receive compensation.

What can you do?

If you see a dangerous dog, report it to the local animal bylaw office. The animal control officer will take into custody a dog that appears to be a threat to public health and safety. Although it’s not required for a dog to attack or bite a person to be considered a danger, it can help to establish a history of aggressiveness of the dog. The dog may even be removed before it attacks or bites a person.

If you are the owner of a dog, ensure that your dog is unable to escape your property. Dogs have been known to go over a fence, or under. They can pull their owners on a leash or run out of a door. Be aware of any situation where your dog can escape and make sure they will not be able to. There have been many cases where an owner had no indication or suspicion that their dog would react violently in a certain situation.

This is a devastating outcome for the family to suffer. The dogs’ owner should be held responsible for the damages that his dogs have inflicted. Our condolences and prayers are sent to the family.
